Consider the case wherein a person refuses to listen to a woman’s testimony of leadership, due to the belief that women are incompetent. This is testimonial injustice. It involves the hearer’s prejudicial belief over the speaker’s socially imagined identity. This injustice creates lasting kinds of harms to one’s epistemic self-respect and freedom, as the hearer gives a decreased credibility level to the speaker. In Epistemic Injustice: Power and the Ethics of Knowing, Miranda Fricker proposes the virtue of testimonial justice, which (...) aims to restrain identity prejudice from harming speakers. With this, the hearer reflexively identifies her prejudice and corrects or suspends it. In this essay, I argue that employing the cognitive attitude of suspension is counter-effective to the purpose of the virtue. I explain my argument through the following: 1) the relationship of inquiring attitudes (IAs) with the attitude of suspension; and 2) the argumentative function of reason. Through the suspension of prejudice an IA over the prejudice is acquired by the hearer. Consider, “Is my belief that all women are weak, true?” From this, the argumentative function of reason, and confirmation bias, a metacognitive desire to reaffirm and reestablish the prejudice arises. Thus, defeating the purpose of the virtue. As such, I suggest the attitude of acceptance instead, which serves as settled judgement over the prejudice’s truth and need not involve belief. Through it, the hearer does not inquire over the status of the prejudice’s truth, removing the problems presented by suspension of judgement. (shrink)

In this review, we present some ethical imperatives observed in this pandemic from a data ethics perspective. Our exposition connects recurrent ethical problems in the discipline, such as, privacy, surveillance, transparency, accountability, and trust, to broader societal concerns about equality, discrimination, and justice. Recently, a strong hylomorphic reading of Aristotelian emotions has been put forward, one that allegedly eliminates the problem of causal interaction between soul and body. Taking the presentation of emotions in de An. I 1 as a starting point and basic thread, but relying also on the discussion of Rh. II, I will argue that this reading only takes into account two of the four causes of emotions, and that, if all four of them are included into the picture, then (...) a causal interaction of mind and body remains within Aristotelian emotions, independent of how strongly their hylomorphism is understood. Beyond the discussion with this recent reading, the analysis proposed of the fourfold causal structure of emotions is also intended as a hermeneutical starting point for a comprehensive analysis of particular emotions in Aristotle. Through the different causes Aristotle seems to account for many aspects of the complex phenomenon of emotion, including its physiological causes, its mental causes, and its intentional object. In this paper I address some aspects of the discussion of Aristotle against materialism. I take as a starting point the inaugural sentence of Phys. 2.4, where Aristotle refers to the endoxon that there are things which are (einai), and things which become or are generated (gignesthai) by chance. In the first place, I show that Aristotle would have ascribed to the materialists (especially Empedocles) the opinion that things like animals and plants can be (and not only become) by chance. (...) I shall argue that, in fact, this thesis implies that it is not only the compound that is generated, but also the form or eidos of the living being. To this extent, I propose that there are strong reasons for Aristotle to reject that living beings may be by chance, and to circumscribe chance to that which becomes or is generated. In other words: chance can occur within processes of generation but has nothing to do with the causes and principles of those processes. Thus, this repositioning of chance within the sole field of what becomes is closely connected to the causal priority of the eidos in the processes of generation. (shrink)

This paper deals with Aristotle’s concept of chance, such as it is presented in Physics II 4-6. The central section of the article concentrates on an analysis of Aristotle’s definition of chance and its essential peculiarities: the fact of being an incidental (efficient) cause and the fact of existing in the domain of what is for the sake of an end. According to Rossi, both characteristics would correspond to a causal aspect (in an incidental sense) and to a non causal (...) aspect (or just apparently causal) of chance. Finally, the author also tries to show the structural connection between the aforementioned aspects, taking as a key point the thesis of coincidence among the formal, final, and efficient causes. This paper deals with Plato’s theoretical views on rhetoric, its value, its conditions, and its genuine ethical-political function. My goal is to show that, even from the theoretical and/or metarhetorical point of view (Gorgias and Phaedrus), Plato would admit the practice of arguing from probabilities (eikós) and opinions, and would accept as a legitimate part of rhetoric –in order to persuade the mob– devices such as appeals to emotion. As it is well known, concrete uses of these devices can be (...) found in the dialogues. I will refer, in this vein, to some passages of Plato’s political writings, esp. Republic and Laws, and to the role of some myths in the dialogues. Nonetheless, I sustain the necessity (and the possibility) of harmonizing this view, with Plato’s strong claim that knowledge of (and commitment to) an objective truth is essential to the true rhétor. The text of Physics 2.8 has been recently interpreted so as to restore the reading that Aristotle holds an external, and even an anthropocentric, natural teleology. This reading has been defended by D. Furley, and especially by D. Sedley. In this paper I present several arguments against this interpretation of the text. Thus, I will argue that Aristotle does not claim, in this chapter, that it rains for the sake of the growing of the crop, against an opinion which is (...) currently somewhat extended among interpreters. It provides basic definitions of the concept of the sharing economy as well as the primary meanings related to the subject of the analysis undertaken in the subsequent chapters. This Introduction also includes a description of the main benefits of the analysis of the sharing economy from a European perspective. It highlights that the idea of the book emerged from the collaboration of most co-authors in the COST Action CA16121 ‘From Sharing to (...) Caring: Examining Socio-Technical Aspects of the Collaborative Economy.’ Finally, the outline of the book is presented, providing a description of the content of each chapter within this academic collection. Critical examination of Alchourrón and Bulygin’s set-theoretic definition of normative system shows that deductive closure is not an inevitable property. Following von Wright’s conjecture that axioms of standard deontic logic describe perfection-properties of a norm-set, a translation algorithm from the modal to the set-theoretic language is introduced. The translations reveal that the plausibility of metanormative principles rests on different grounds. Using a methodological approach that distinguishes the actor roles in a norm governed interaction, it has been shown that metanormative principles (...) are directed second-order obligations and, in particular, that the requirement related to deductive closure is directed to the norm-applier role rather than to the norm-giver role. The approach has been applied to the case of pure derogation yielding a new result, namely, that an independence property is a perfection-property of a norm-set in view of possible derogation. This paper in a polemical way touches upon several points raised by Kristan in his recent paper. (shrink)

From 1950 onwards, the study of creativity has not stopped. Today, AI has revitalised debates on the subject. That is especially controversial in the artworld, as the 21st century already features AI-generated artworks. Without discussing issues about AI agency, this article argues for AI’s creativity. For this, we first present a new functionalist understanding of Margaret Boden’s definition of creativity. This is followed by an analysis of empirical evidence on anthropocentric barriers in the perception of AI’s creative capabilities, which is (...) later criticised for considering insights from media theory. Finally, benefits derived from including AI as an artistic creative producer and supportive tool are discussed. It is then argued that AI can contribute to democratising the artworld. En el presente trabajo reflexionamos en torno a una serie de textos en los que Michel Foucault se pregunta por estatuto de la crítica. La cuestión nos parece volverse reflexivamente sobre el propio Foucualt y por ello intentaremos evaluar de qué manera, con sus propios recursos conceptuales, se puede determinar el estatuto de su propio discurso. Para ello recorreremos dos caminos: (i) su rechazo de la noción de ideología que lo pone en tensión con algunas de las tradiciones mayores del (...) pensamiento crítico. La cuestión es aquí: ¿cómo es posible la crítica sin la ideología y sin la verdad?; (ii) la recuperación foucaultiana de la actitud crítica (en los textos sobre Kant y la pregunta Was ist Aufklärung?). A partir de allí Foucault recupera la problemática de la modernidad en términos de una “ontología histórica del presente”. Ambos caminos se cruzan, ya que las observaciones sobre una “política de la verdad” (lo otro de la crítica de la ideología comprometida con una verdad aséptica) se refuerzan con las de la cuestión del gobierno en términos de una “inservidumbre voluntaria”. En ambos casos, la práctica de la crítica, que subjetiviza desujetando, plantea la cuestión de la libertad. -/- We analyze Michel Foucault’s question for the status of critique and its reflexive return over Foucault himself: How Foucault’s discourse, qua critique, should be understood? We will drive two paths: (i) the refusal of the notion of ideology, where the question is: How to think of critique without ideology and truth?; (ii) the Foucauldian recovery of the “critical attitude” (in the texts on Kant’s answer to the question Was ist Aufklärung?) and of the problem of modernity, along the lines of a “historical ontology of the present”. There is a crossroad of (i) and (ii), since the remarks on a “politics of truth” (as opposite to an “ideology critique” committed with an aseptic truth) reinforces mutually with the problem of the government, faced along the lines of an art of the “voluntary inservitude”. In both cases, practice of criticism that subjectifies desubjugating, poses the question of liberty. (shrink)

La exposición y crítica de las doctrinas antiguas tiene un lugar importante en los escritos de Aristóteles. Sin embargo, ciertas dudas se han vuelto corrientes acerca de la confiabilidad de sus descripciones. Más aún, se ha sostenido que Aristóteles deforma la comprensión histórica a través de la introducción de conceptos y términos propios. En este libro se aborda el problema a través de un análisis de las críticas que Aristóteles dirige a la teoría platónica de las Ideas, que permite explicar (...) la constitución y desarrollo de importantes conceptos aristotélicos a partir de la confrontación dialéctica con las doctrinas de su maestro. En efecto, las dificultades genuinas que Aristóteles descubre en el platonismo constituyen el motor para gestar nuevos conceptos, que no son ajenos, sino que surgen como implicaciones del examen crítico. Así, la imposición de términos propios no debe interpretarse como distorsión, sino como el modo que Aristóteles adopta para exhibir su particular solución a los problemas que los filósofos anteriores dejaron sin solución. Frente a quienes sostienen una incompatibilidad entre historia de la filosofía y filosofía, en cuanto plantean una disyuntiva entre una práctica descriptiva y una argumentativa, en este trabajo nos proponemos mostrar, examinando la labor histórico-filosófica de Aris- tóteles, que esa disyuntiva no es excluyente. Para ello, en primer lugar, examinaremos algunos pasajes de su obra en los que ofrece indicaciones metodológicas que permiten comprender la doble función que cumplen las exposiciones críticas de los filósofos precedentes en la constitución misma de (...) su filosofía. En segundo lugar, ilustraremos el tipo de argumentación aristotélica a través del análisis de las críticas que dirige a las Ideas platónicas como causas. Contra Platón, Aristóteles establece que, para dar cuenta de la ingenerabilidad e incorruptibilidad de las formas, no es necesario caracterizarlas como entidades separadas de la materia y del movimiento. Basta asegurar la eternidad de la forma a través de su reproducción en otros individuos de la misma especie. Tal análisis nos permite concluir, finalmente, que filosofía o historia de la filosofía constitu- yen una falsa disyuntiva en Aristóteles, por lo que el examen dialéctico de las doctrinas precedentes es un método adecuado de indagación filosófica. The book titled The Collaborative Economy in Action: European Perspectives is one of the important outcomes of the COST Action CA16121, From Sharing to Caring: Examining the Socio-Technical Aspects of the Collaborative Economy that was active between March 2017 and September 2021. The Action was funded by the European Cooperation in Science and Technology - COST. The main objective of the COST Action Sharing and Caring is the development of a European network of researchers and practitioners interested in investigating the (...) collaborative economy models, platforms, and their socio-technological implications. The network involves scholars, practitioners, communities, and policymakers. The COST Action Sharing and Caring helped to connect research initiatives across Europe and enabled scientists to develop their ideas by collaborating with peers. This collaboration opportunity represented a boost for the participants’ research, careers, and innovation potential. The main aim of this book is to provide a comprehensive overview of the collaborative economy in European countries with a variety of its aspects for a deeper understanding of the phenomenon as a whole. For this reason, in July 2017, an open call for country reports was distributed among the members of the COST Action Sharing and Caring. Representatives of the member countries were invited to produce short country reports covering: definition of the CE; types and models of the CE; key stakeholders involved; as well as legislation and technological tools relevant for the CE. Submitted reports varied in length and regarding the level of detail included, in accordance with how much information was available in each respective country at the time of writing. Editors of the book have compiled these early reports into a summary report, which was intended as a first step in mapping the state of the CE in Europe. The Member Countries Report on the Collaborative Economy, edited by Gaia Mosconi, Agnieszka Lukasiewicz, and Gabriela Avram that was published on the Sharing and Caring website, represented its first synergetic outcome and provided an overview of the CE phenomenon as interpreted and manifested in each of the countries part of the network. Additionally, Sergio Nassare-Aznar, Kosjenka Dumančić, and Giulia Priora compiled a Preliminary Legal Analysis of Country Reports on Cases of Collaborative Economy. In 2018, after undertaking an analysis of the previous reports’ strengths and weaknesses, the book editors issued a call for an updated version of these country reports. Prof. Ann Light advised the editorial team, proposing a new format for country reports and 4000 words limit. The template included: Introduction, Definition, Key Questions, Examples, Illustration, Context, Developments, Issues, Other Major Players, and Relevant Literature. The new template was approved by the Management Committee in October 2018. The task force that had supported the production of the first series of country reports acted as mentors for the team of authors in each country. The final reports arrived at the end of 2018, bringing the total number of submissions to 30. A call for book editors was issued, and a new editorial team was formed by volunteers from the participants of the COST Action: Andrzej Klimczuk, Vida Česnuityte, Cristina Miguel, Santa Mijalche, Gabriela Avram, Bori Simonovits, Bálint Balázs, Kostas Stefanidis, and Rafael Laurenti. The editorial team organized the double-blind reviews of reports and communicated to the authors the requirements for improving their texts. After reviews, the authors submitted updated versions of their country reports providing up-to-date interdisciplinary analysis on the state of the CE in 2019, when the reports were collected. During the final phase, the chapters were again reviewed by the lead editors together with all editorial team members. At the time, the intention was to update these reports again just before the end of the COST Action Sharing and Caring in 2021 and to produce a third edition. However, the COVID-19 pandemic changed these plans. Es común escuchar que el mundo Occidental debe a los árabes el descubrimiento del álgebra. No obstante, el desarrollo de esta disciplina puede interpretarse como un crisol de distintas tradiciones científicas que fue posible gracias a la clasificación, traducción y crítica tanto de los clásicos como de las obras que los árabes obtuvieron de los pueblos que conquistaron. Entre estos trabajos se encontraba Los Elementos de Euclides. Los Elementos fueron cuidadosamente traducidos durante el califato de Al-Ma’mūn por el matemático Mohammed (...) ibn-Musa Al-Khwārizmī, autor de Al-jabr wa’l muqābalah, quien sentó los fundamentos de la disciplina que más tarde sería conocida como álgebra y quien, en la primera parte de su obra, nos proporciona tres métodos para resolver tres tipos de ecuaciones que llama “ecuaciones combinadas”. A lo largo de este artículo se ofrecen argumentos para sostener que los métodos para resolver estas ecuaciones constituyen una reinterpretación, en el terreno algebraico, de los teoremas 6, 7 y 8 del segundo libro de Los Elementos de Euclides. Mi objetivo es dar respuesta a la siguiente pregunta: ¿Qué lectura de Los elementos Euclides posibilitó la emergencia del álgebra en el mundo árabe? Para responderla necesario explorar el acercamiento que los árabes tuvieron con el Libro II de Los Elementos, con el fin de proponer una interpretación de los posibles factores que los llevaron a formular el álgebra. In this paper, I will be primarily concerned with moral issues regarding future people and the environment. When it comes to the future, we have deontological and epistemic limitations. The closer to the present, the higher the certainty and the knowledge we have about facts. Thus, when we intend to find moral clarity regarding a future scenario, we deal with an inverse relation between certainty and time. The main problem is that most ways of dealing with moral issues about future (...) scenarios do not address this relation, and rather focus on things that seem to simplify and clarify the uncertainties of the future. In response to this, I propose a different approach, one that operates neutrally and timelessly dealing with the uncertainties of the future while providing moral groundings that can help to clarify the future’s state of moral vagueness. Este trabajo de campo, se produce dentro de un acuerdo interinstitucional, el que tiene como objetivo aportar a la permanencia y desarrollo sustentable de la quesería artesanal de la región oeste, sur y este del Uruguay. La mayoría de estos productores agropecuarios familiares se encuentran en un proceso de formalización de su producción y comercialización. Cuentan con escasa información que dificulta introducir la gestión de costos en los establecimientos. Es así que se seleccionaron 9 establecimientos como una fase piloto, con (...) el propósito analizar el costo de la producción de queso artesanal en la etapa “previa a la maduración”. Entendiendo que el objetivo de este trabajo es facilitar al productor la toma de decisiones relativas a precios y dada la escasa o nula información de períodos anteriores, se optó por un modelo de costo variable resultante, aunque de forma híbrida ya que ciertos datos se basaron en la especificación técnica y el periodo observado es de solamente una elaboración y no de la totalidad de elaboraciones realizadas en el mes, como es usual en la práctica de cálculo de costos resultantes. A efecto de cumplir con el objetivo del trabajo se realizaron las siguientes actividades en cada establecimiento: 1. Se visitó la quesería artesanal. 2. Se mantuvo una entrevista personal con el propietario del establecimiento con el objetivo de relevar información relacionada al proceso, y los factores productivos intervinientes en el mismo. 3. Se trabajó con la Información histórica obtenida de registros que aportó el productor. 4. Asimismo, se consideraron especificaciones técnicas proporcionadas por los especialistas. Es así que, mediante esta metodología de costeo aplicado en cada uno de los establecimientos, el productor estaría en condiciones de conocer el precio mínimo al que puede vender un kg de queso, no es conveniente hacerlo por debajo del costo variable. No obstante, el productor debe tener presente que la diferencia entre el precio pactado de venta menos su costo variable (denominado contribución marginal), va en primera instancia a cubrir los costos fijos. Dado que se relevó solo un día, en todos los establecimientos el único supuesto razonable es que la producción sea relativamente constante en los 30 días, si fuera ese caso, la producción mensual seria aproximadamente el monto del kg a la venta. Como limitación al alcance de este trabajo, es que lo anterior es adecuado cuando no existe un proceso de maduración, en el caso de que el mismo existiera deberá adicionarse el costo variable de dicho proceso, que consiste básicamente en la cuantificación del valor tiempo del dinero o costo de la inmovilización del capital, así como las mermas que se incurren en el proceso de maduración. Self-control is deemed crucial for reasons-responsive agency and a key contributor to long-term wellbeing. But recent studies suggest that effortfully resisting one’s temptations does not contribute to long-term goal attainment, and can even be harmful. So how does self-control improve our lives? Finding an answer requires revising the role that overcoming temptation plays in self-control. This paper distinguishes two forms of self-control problems: temptation (the presence of a strong wayward motivation) and apathy (the lack of commitment-advancing motivation). This distinction makes (...) it possible to separate negative self-control (aimed at overcoming temptation) from positive self-control (aimed at overcoming lack of motivation). The paper argues that temptation should not play a central role in our conception of self-control, since overcoming temptation is neither necessary nor sufficient for successful self-control. Transdisciplinary research knits together knowledge from diverse epistemic communities in addressing social-environmental challenges, such as biodiversity loss, climate crises, food insecurity, and public health. This paper reflects on the roles of philosophy of science in transdisciplinary research while focusing on Indigenous and other subaltern forms of knowledge. We offer a critical assessment of demarcationist approaches in philosophy of science and outline a constructive alternative of transdisciplinary philosophy of science. While a demarcationist focus obscures the complex relations between epistemic communities, transdisciplinary (...) philosophy of science provides resources for meeting epistemic and political challenges of collaborative knowledge production. Recent years have seen a heightened focus on the study of minimal forms of awareness during sleep to advance the study of consciousness and understand what makes a state conscious. This focus draws on an increased interest in anecdotical descriptions made by classic Indian philosophical traditions about unusual forms of awareness during sleep. For instance, in the so-called state of witnessing-sleep or luminosity sleep, one is said to reach a state that goes beyond ordinary dreaming and abide in a state (...) of just awareness, a state in which one is not aware of anything else other than one’s own awareness. Moreover, for these traditions, this state is taken to be the essence or background of consciousness. Reports on such a state opens the door to exciting new lines of research in the study of consciousness, such as inquiry into the so-called “objectless” awareness during sleep—states of awareness that lack an ordinary object of awareness. In this two-staged research project, we attempted to find the phenomenological blueprints of such forms of awareness during sleep in 18 participants by conducting phenomenological interviews, informed by a novel tool in qualitative research, the micro-phenomenological interview (MPI) method. Following a phenomenological analysis, we isolated a similar phase across 12 reported experiences labelled as ‘nothingness phase’ since it described what participants took to be an experience of ‘nothingness’. his common phase was characterised by minimal sense of self—a bodiless self, yet experienced as being ‘somewhere’—, the presence of non-modal sensations, relatively pleasant emotions, an absence of visual experience, wide and unfocused attention, and an awareness of the state as it unfolded. Street-level bureaucrats are a fundamental part of the implementation process of any policy. This study provides an examination of the factors that shape the behavior of street-level bureaucrats at the frontlines of policy implementation. This study investigates how rebelliousness generates an impact on the discretion of street-level bureaucrats and to what extent client meaningfulness plays a moderating factor. It utilizes a survey questionnaire distributed among inspectors of the Department of Labor in the Ministry of Human Resources of Malaysia (n=241). The (...) result of this study demonstrates that rebelliousness has a negative relationship with discretion, and client meaningfulness has a direct positive correlation with discretion. However, the relationship between rebelliousness and discretion is stronger with a high level of client meaningfulness. The objective of this study is to examine street-level bureaucrat behavior through the lens of Lipsky's theory which will provide an answer to the broad question of the factors that contribute to the existence of an imperfect implementation process. This study sheds light on the importance of client meaningfulness in moderating the behavior of street-level bureaucrats while interacting with inspectees. The novelty of this study is by highlighting two main constructs that are likely contributing to the implementation process by directly and indirectly impacting bureaucrats’ discretion: rebelliousness, and client meaningfulness. In the human sciences, experimental research is used to establish causal relationships. However, the extrapolation of these results to the target population can be problematic. To facilitate extrapolation, we propose to use the statistical technique Latent Class Regression Analysis in combination with the analogical reasoning theory for extrapolation. This statistical technique can identify latent classes that differ in the effect of X on Y. In order to extrapolate by means of analogical reasoning, one can characterize the latent classes by a (...) combination of features, and then compare these features to features of the target. The term collaborative economy itself is relatively new, and according to the European Commission, the term is used interchangeably with the term sharing economy. The term SE was frequently used when early models, such as Airbnb or ZipCar, appeared and gained popularity, especially in the United States, but it was afterwards substituted with the term CE in the European contexts. The country reports in this collection often use the two terms interchangeably, further illustrating the fact that a generally agreed definition (...) is still missing. However, the ambition driving the term CE is to create specific European economic models with greater emphasis on the community’s involvement. In Europe, it is still the case that the definition of the CE and SE remains fuzzy, including both non-profit and for-profit models, supported by both monetary and non-monetary exchanges among participants. The phenomenon is complex, covering various fields of activity, as well as operating at various levels, ranging from the international to the national, regional, and local. Some definitions focus mostly on sustainability, while others highlight technological and financial aspects and business models specific to the phenomenon. This chapter is organized as follows. This book takes us to explore the 'life of robots' and presents us with a refreshing narrative that demystifies their recurrent anthropomorphic understanding. El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

The chapter is the final one in the volume of collected papers aiming to discuss the sharing economy in Europe. The idea of the book emerged within the research network created by the COST Action CA16121 ‘From Sharing to Caring: Examining Socio-Technical Aspects of the Collaborative Economy.’ The authors of the chapter sum up theoretical and empirical materials as well as country-specific cases provided in the book. The article critically assesses the current status of the sharing economy in European countries (...) by highlighting major controversial issues related to deregulation, market disruption, or social inequality. The authors conclude that, considering the comprehensive and up-to-date materials collected and analysed in the book, it may become an outstanding source of knowledge and a practical tool in the process of expansion of the sharing economy in Europe and beyond. Volumul ”Sustenabilitatea educației doctorale în economie și afaceri” valorifică ideile și cercetările doctoranzilor de la Universitatea “Alexandru Ioan Cuza” din Iași, școala doctorală de economie și administrarea afacerilor. Lucrările au fost prezentate, prin postere sau în plen, în conferința finală a proiectului SESYR, finanțat prin programul european Jean Monnet. Structurarea volumului în patru subcapitole generice are ca scop valorificarea domeniilor considerate prin filosofia proiectului:managementul proiectelor, antreprenoriat si angajabilitate pentru tinerii cercetători. O colecție de 24 de articole având 35 de autori, (...) oferă un mediu de dezbatere științifică provocatoare pentru publicul cititor din domeniul economic. Focalizarea subiectelor din articolele prezente pe motivațiile de cercetare ale doctoranzilor și postdoctoranzilor face ca acest volum să reprezinte un debut publicistic pentru unii autori iar pentru alții, o consolidare a vocației. Diseminarea pasiunilor în astfel de contexte consolidează colaborarea și deschiderea spre noi subiecte investigative. Volumul este destinat studenților, cercetătorilor și profesorilor și îl propunem ca reper bibliografic pentru dezvoltarea altor idei de cercetare și inovare în arealul nostru tematic. (shrink)

En la Constitución de la República de Polonia del 2 de abril de 19971 se reconocía el carácter objetivo de ciertos valores y un cognoscitivismo axiológico. Si tomamos las disposiciones constitucionales en serio tenemos que aceptar que algunas valoraciones morales o que algunas proferencias [utterances] valorativas pueden ser verdaderas o falsas y que nos informan acerca de una realidad objetiva. Por otro lado, en la teoría del derecho polaca y en los cursos universitarios de lógica para abogados se encuentran definiciones (...) de la justificación axiológica de las normas y de normas axiológicas (normas que poseen una justificación axiológica) que presuponen que ningún valor es objetivo y que no pueden ser conocidos — se presupone un no-cognoscitivismo axiológico. De acuerdo con el no-cognoscitivismo, ninguna valoración y ninguna proferencia valorativa puede ser verdadera o falsa, ni puede informar acerca de la realidad. O artigo tem como objetivo apresentar o problema da determinação do sentido das normas para o Kelsen considerando a flexibilidade do quadro de interpretações. Expõe, primeiramente, a suposta transição do conceito de interpretação normativa, passando de um formalismo-normativismo restritivo para um realismo jurídico a partir das suas últimas obras; em um segundo momento apresenta o decorrente conflito ainda atual constituído por essas reformulações. Finalmente, defende a hipótese de superação da dicotomia formalismo-normativismo versus realismo jurídico através de uma leitura realista normativista.

El presente trabajo tiene como objetivo analizar los principales cambios que implicará para aquellos ejercicios iniciados a partir del 1 de enero de 2018, la entrada en vigencia de la Norma Internacional de Información Financiera (NIIF) 15 – Ingreso de Actividades Ordinarias Procedentes de Contratos con Clientes- sustituyendo a las Norma Internacional de Contabilidad (NIC) 11 – Contratos de Construcción-, NIC 18 – Ingresos de Actividades Ordinarias-, Interpretación desarrollada por el Comité de Interpretaciones de las Normas Internacionales de (...) Información Financiera (CINIIF) 13 – Programas de Fidelización de Clientes-, CINIIF 15 – Acuerdos para la Construcción de Inmuebles-, CINIIF 18 – Transferencias de Activos procedentes de Clientes-, e Interpretación desarrollada por el Comité de Interpretaciones de Normas Internacionales de Contabilidad (SIC) 31 – Ingresos-Permutas de Servicios de Publicidad-. A tales efectos, analizaremos los principales lineamientos contables establecidos por la NIIF 15, a través del modelo de las cinco etapas y de otros aspectos que a nuestro entender son importantes presentando algunos casos prácticos para un mejor entendimiento. In his paper “Obras de ficción, formas de conciencia y literatura”, Josep Corbí raises a few sharp objections to my distinction between fiction and non-fiction, as I formulate it in my recently published Relatar lo ocurrido como invención. In this response, I present first in a compact form such ideas, and then I try to answer to Corbí’s criticisms.

Con una metodología analítico-sintética, el propósito del presente artículo es ofrecer un fundamento teórico sobre la legitimidad de los actos y las decisiones morales. Por consiguiente, se resolverá la siguiente cuestión: ¿cuál es la función ética del derecho, en el marco del ejercicio de una conciencia y consciencia construidas por agentes morales? Se concluye que la coacción legítima debe fundarse en la protección universal de toda persona y en el sometimiento a objeciones por parte de los ciudadanos, con el propósito (...) de revisar la legitimidad y legalidad de las normas jurídicas. El presente estudio ofrece una interpretación de naturaleza ontológica a uno de los fenómenos más divulgados recientemente por los medios informativos de comunicación: la displicencia de los sujetos al seguimiento de normas sociales. El trabajo se centra, especialmente, en los casos en los que se asume que la indiferencia a las normas tiene como causa la condición del privilegiado social. Argumenta que la inobservancia a las normas, más que ser un asunto de desigualdad social, es la sintomatología de importantes hendiduras (...) en la ontología de la realidad social. Así, tres partes conforman este trabajo. En la primera se describen algunos casos que, desde los medios de comunicación, se presentan como representativos en la inobservancia a las normas sociales, especialmente, aquellos que son interpretados como un asunto de abuso de privilegio social. En la segunda parte, a partir de algunos trabajos de John Austin, Ulises Moulines y Gottlob Frege, se presenta una concepción de normas sociales, y su valor para la construcción de la ontología social. En la tercera parte, desde la propuesta del filósofo John Searle, se describen algunos rasgos esenciales de la ontología de la realidad social. Se concluye que el no seguimiento de las normas sociales socava los modos de existencia de la realidad social, y que los casos interpretados por los medios de comunicación como asunto de desigualdad social, requieren una interpretación que tenga en cuenta la estructura de la realidad social. Com este artigo procura-se introduzir a questão da origem social das normas morais e jurídicas a partir da obra de Hans Kelsen e solucionar, de forma breve, o problema da conciliação do método lógico-transcendental da Teoria pura com a filosofia positivista e empirista do autor.

Desde un punto de vista postmetafísico y a partir de los argumentos que nos proporciona un autor como Ludwig Wittgenstein, trataremos de defender la tesis de que las normas en general cobran su carácter normativo de la responsabilidad que se atribuye a cada agente cuando, al actuar en sociedad, se liga a los compromisos que sostienen la posibilidad de que esa acción sea común. Esos compromisos, ya que no pueden responder ante una instancia ajena a los agentes sociales , habrán (...) de tener el cariz práctico de todo lo que atañe en exclusiva a los afanes de los humanos entre sí. Una regla no nos pide que respondamos de su cumplimiento o no, pero nosotros sí que podemos pedirnos cuentas unos a otros de ese cumplimiento o vulneración a partir de la responsabilidad compartida en la vida social en que pululan tales reglas; de hecho, a aquellos que las incumplen gravemente, siempre podemos apartarlos definitivamente de nuestra vida en sociedad adjudicándoles «maldad» o «locura» persistente. Al caer así en la cuenta de que las reglas tienen sólo este género de responsabilidad mutua, una nueva regla se nos puede hacer plausible junto a las demás: la de tolerar la posibilidad de otros compromisos con diferentes reglas en otros contextos que hayan generado otras responsabilidades diferentes a las nuestras. O propósito deste trabalho é analisar a estrutura e discutir a aplicação da(s) lógica(s) deôntica(s) na representação de normas jurídicas. Após uma apresentação desta(s) lógic(s) e, em particular, do sistema de von Wright e da SDL (Standard Deontic Logic), veremos as dificuldades de se aplicar uma lógica à análise do direito positivo: as regras da lógica devem permitir realizar sobre as normas formalizadas somente os tipos de inferência e operaçôes lógicas intuitivamente feitas pelos juristas, ou seja, a reconstrução lógica do (...) direito positivo não se trata de uma tarefa de criação do direito, mas uma tarefa de representação daquilo que o conceito de direito usual reconhece como tal. Para ilustrar estas dificuldades, abordaremos as propostas de Carlos Alchourrón em artigo de 1975, “Condicionalidad y la representación de las normas jurídicas”. (shrink)

In this text we try to summarize the axiological and ethical theories, as well as its relation with human rights -HR- that is developed from scientific philosophy: a philosophy that seeks to construct general conceptual systems that are clear and exact, and tries to adjust itself to the sciences of its time, to feed back with them. In this way, it is investigated in the practical philosophy faced with the maximum possible rigor and focused on achieving certain objectivity; a technical (...) philosophy. All along this work we develop the central concepts, hypothesis and prescriptions of the practical philosophy on the scientific substrate available. It also proposes some ideas critical of ‘human rights’ that may be of interest to jurists and legal theorists. The final objective of these critics it is not the refutation or suppression of HR, but just the opposed: their strength reaffirmation with the improvements and readjustments required. (shrink)

Una de las tesis que tradicionalmente han sido defendidas por la tradición del positivismo jurídico es la tesis coactiva, según la cual el derecho consiste en un conjunto de normas coactivas, en el sentido de impuestas por medio de la fuerza. Pero, sin abandonar esta corriente, ha habido históricamente diversas maneras de entender las relaciones entre derecho y fuerza. Si, pues, hasta comienzos del s. XX era opinión común la idea de que el derecho constituía un conjunto de mandatos o (...) normas de conducta cuya eficacia se garantizaba a través de la amenaza del uso de la fuerza coactiva a los transgresores de aquéllas; a lo largo del siglo pasado, empero, algunos autores muy destacados dieron en sostener la opinión de que la fuerza disponible por jueces y funcionarios venía a constituir sustancialmente el objeto mismo de toda regulación jurídica. Según esta última concepción, el derecho tendría primordialmente la función de articular las condiciones de legitimidad para el uso de la fuerza, designando a los sujetos a los que se encomienda tal uso y determinado los casos y modalidades en los que pueda utilizarse. Entre quienes sustentan la primera tesis, que afirma que la fuerza constituye la garantía del derecho, es lugar común citar a Austin y, a menudo, se cita también a Jhering. Entre los defensores de la segunda tesis común es habitual mencionar a Kelsen, Olivecrona y Ross, habiéndose sustanciado una polémica entre Bobbio y Olivecrona en punto a determinar si fuera menciona Olivecrona o fue Kelsen el primero en adoptarla. Sin embargo, es problemático incluir a Jhering dentro del primer grupo y no dentro del segundo, en cuyo caso habría que atribuirle la primera formulación histórica de la tesis. Este trabajo, de carácter histórico, parte de la citada polémica y trata de verificar la constancia de la segunda tesis en las obras no sólo de Kelsen y Olivecrona, sino sobre todo de Jhering. In this paper, I present two ways of conceiving a genealogical explanation of the concept of knowledge. The first one is through the epistemic state of nature hypothesis developed by Edward Craig, according to which knowledge is understood as a concept evolved from the concept of a good informant. After considering Craig’s project, I draw a parallel between this approach and Miranda Fricker’s value-laden account of the same concept. Then, I present and discuss Fricker’s social take on Craig’s genealogy, in (...) which she suggests that the notions of a good informant and of knowledge are necessarily dependent on the establishment of a credibility norm, and that this norm should be viewed as inherently political. Lastly, I defend an illustration, through Kristie Dotson’s work, of how both genealogical approaches could explain and offer solutions to failings in the normativity of our epistemic systems. (shrink)
